1. Agreement

These Terms of Use govern your access to the Fide Island website and macOS application. By downloading, installing, purchasing, or using Fide Island, you agree to these Terms. If you do not agree, do not use the product.

"Fide Island," "we," "us," and "our" refer to the developer or business operating Fide Island. The final legal operator name and address should be inserted into production legal metadata before commercial launch.

2. Product and requirements

Fide Island is a macOS utility that places an interactive surface around the MacBook notch or at the top of a selected display. The current product targets macOS 14 or later. Some functionality depends on macOS permissions, other applications publishing Now Playing information, network availability, or third-party services.

Features may include media controls, calendar, temporary file Shelf, clipboard history, calculator, currency conversion, system-status feedback, weather, launch at login, and an optional Gemini assistant.

3. Software license

Subject to these Terms and any paid entitlement, Fide Island grants you a limited, personal, revocable, non-exclusive, non-transferable license to install and use the application for your own lawful use. You do not receive ownership of the application, source code, trademarks, or other intellectual property.

You may not resell access, remove legal notices, circumvent licensing or security controls, use the product to violate law or another person's rights, or distribute modified copies unless separately permitted in writing or by an applicable open-source license.

4. Subscription and billing

The early-access base price is US $1 per month. Paddle localizes the displayed total and may add or include applicable tax. The exact recurring total, currency, renewal frequency, and payment terms shown in Paddle Checkout control the purchase.

Paddle acts as merchant of record and its checkout and customer terms also apply. Subscriptions continue until canceled through the Paddle customer portal. Cancellation stops future renewals and ordinarily leaves access active through the paid period unless Paddle or applicable law requires otherwise.

5. Third-party services and components

Some Fide Island features depend on third parties, including macOS frameworks, MediaRemoteAdapter, Frankfurter, Google Gemini, Open-Meteo, and a YouTube image host in a narrow fallback path. Their availability, terms, output, rate limits, and data handling are controlled by those providers.

If you use the optional Gemini assistant, you are responsible for your API key, your Google account or API terms, and the content you choose to submit.

6. Compatibility, beta behavior and changes

Fide Island may be changed, updated, suspended, or discontinued. Features that depend on undocumented or restricted macOS behavior, including system-wide Now Playing compatibility, may break after macOS updates and may require maintenance.

We may add, remove, or modify features for security, compatibility, performance, product direction, or legal reasons. We will not intentionally use a product update to override rights that cannot be waived under applicable consumer law.

7. Data and permissions

Your use of Fide Island is also governed by the Privacy Policy. You control optional permissions through macOS System Settings and the application's own settings. Disabling a permission may disable the related feature.

8. Acceptable use

You agree not to use Fide Island to interfere with other systems, bypass security protections, violate intellectual property rights, unlawfully collect another person's data, distribute malware, or abuse third-party APIs. You are responsible for files and content you place into Shelf, clipboard, or AI prompts.

9. Disclaimers

To the maximum extent allowed by law, Fide Island is provided "as is" and "as available." We do not guarantee uninterrupted availability, compatibility with every Mac, browser, media application, currency rate, weather result, or AI response. Information shown by third-party services may be delayed, incomplete, or inaccurate.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

10. Limitation of liability

To the maximum extent permitted by law, the operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising from use of Fide Island. Any monetary cap must be interpreted subject to rights and remedies that cannot be limited by law.

11. Termination

You may stop using Fide Island at any time. We may suspend or terminate access for material breach, fraud, abuse, legal requirements, or security risk, subject to applicable law and any paid subscription rights.

12. Governing law

Because the operator's legal entity and jurisdiction have not yet been supplied for this build, this draft does not hard-code a governing-law venue. Before commercial launch, insert the operator's legal name, address, and governing-law clause, while preserving any mandatory consumer protections that apply where a customer lives.

13. Changes and contact

We may update these Terms as the product, billing model, or legal requirements change. The effective date above should be updated when material revisions are published.
